Privacy Policy Statement by AYBEY ELEKTRONIK GmbH (Version 06/2018)

We as AYBEY ELEKTRONIK GmbH would like to express our delight about your visit on our website as well as about your interest in our company and products. We take the protection of your data very seriously and hope that you feel comfortable during your visit on our website. Our main concern, which we observe thoroughly in our business processes, is your privacy. This Privacy Policy solely affects the processing of personal data, which we collect in the context of providing our website http://www.aybey-elektronik.de and which are provided by you voluntarily. The processing of this data is conducted according to the applicable data protection law of the General Data Protection Regulation [Directive (EU) 2016/679; page 1f. of Directive EU 4th May 2016 L 119, hereinafter referred to as “GDPR”] and in accordance with the applicable national data protection regulations prevailing for us.

I. Definitions

This Privacy Policy is based on the definitions in Art. 4 GDPR. We would like to inform you about the here used definitions in advance, in order to promote transparency and comprehensibility:

  1. „Personal Data“

Personal data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

  1. „Data Subject“

A data subject is any identified or identifiable natural person, whose personal data is processed by the controller.

  1. „Processing“

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

  1. „Restriction of Processing“

Restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future.

  1. „Controller“

Controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

  1. „Processor“

Processor means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

  1. „Third Party“

Third party means a natural or legal person, public authority, agency or body other than the data subject, Controller, processor and persons who, under the direct authority of the Controller or processor, are authorized to process personal data.

  1. „Consent“

Consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

II. Controller and Data Protection Officer

Please address the Controller responsible for your personal data acc. to Art. 4 par. 7 GDPR in case of enquiries regarding the processing of your personal data and the enforcement of your data subject rights further described under Fig. VI as well as the enforcement of your right to object.

III. Processing of Personal Data

Visiting our website, our webservers will store information provided to us by the browser used on your terminal device by default. This information will be stored temporarily in a so called logfile. The following information will be gathered without your help and stored until it is erased automatically:

  • IP-address of the accessing terminal device
  • date and time of the access
  • website from which our site was accessed (Referrer-URL)
  • name and URL of the file accessed
  • data quantity transferred
  • type and version of browser used
  • the system software of your terminal device

The data listed above will be processed for the following purposes:

  • ensurance of a trouble-free connection buildup of the website,
  • ensurance of a comfortable use of our website,
  • evaluation of the system security and stability as well as
  • for further administrative reasons.

Additional personal data will only be collected if agreed to or if you give it to us of your own accord e.g. by filling in the contact sheet, in the course of a contact request, for a job application or for the execution of or the request for a contract.

The personal data you provide will be used for purposes of contacting and/or for the execution of the contract concluded with you or requested by you.

Your personal data will be erased if and when they are no longer necessary for the initial purposes. Personal data subject to legal storage times is excluded thereof

IV. Legal Basis for the Processing of Personal Data

The processing of your personal data is based on the regulations of the GDPR.

If we obtain your consent to the processing of personal data, Art. 6 para. 1 lit. a) GDPR serves as legal basis for the processing.

Processing personal data which is required for the performance of a contract to which you are a party, Art. 6 para. 1 lit. b) GDPR serves as legal basis. This also applies for data processing which is required for the execution of precontractual measures, especially during the initiation of a contract and the job application process.

If and when the processing of personal data is required for the compliance of a legal obligation which our company is subject to, Art. 6 para. 1 lit. c) GDPR serves as legal basis.

If the processing is required for the purposes of a legitimate interest of our company or a third party and if your interests, civil rights and basic freedoms are not overridden by the first mentioned interest, Art. 6 para. 1 lit. f) GDPR serves as the legal basis for the processing.

V. Disclosure of your Personal Data

Personal Data will not be disclosed for advertising purposes to third parties.

In the event of disclosure of your personal data to third parties, this is either based on your consent or on one of the legal bases mentioned under cipher VI. or your personal data will be processed on our behalf in accordance with Art. 28 GDPR.

Your personal data may be transmitted to companies located outside the European Economic Area for purposes of execution of orders. In these cases, we ensure compliance with the requirements of the GDPR and ensure that, in addition to the requirements under para. VII also meet the following safety standards:

  • We transfer your personal data to third countries, which have an adequate level of protection within the meaning of the according to Art. 45 GDPR due to a decision of the EU Commission.
  • If such an adequacy decision of the EU Commission does not exist in the third country to which your personal data are transmitted, we ensure that the transmission takes place on the basis of suitable guarantees pursuant to Art. 46 GDPR.

Personal data shall only be transmitted to government institutions and authorities as part of obligatory national legal provisions.

Our employees are obliged to confidentiality.

VI. Data Subject Rights

In order to assert your data subject rights, please address us as controller using the contact means mentioned under fig. II.

  1. Right of Access

According to Art. 15 par. 1 GDPR, you have the right of access to the personal data processed by us. Upon request, we notify you in writing as promptly as possible if and which of your personal data is stored by us. In particular, you may demand information on the purposes of the processing, the category of the personal data, the categories of recipients to which your data was or will be disclosed, the planned duration of the storage, the existence of a right of rectification, erasure or to object, the existence of a right of complaint, the origin of your data as long as they have not been gathered by us as well as on the existence of automated individual decision-making including profiling and p.r.n. significant information on details.

  1. Right to Obtain a Copy

According to Art. 15 par. 3 GDPR, you have the right to request a free copy of all processed personal data concerning your person from the responsible authority. Further copies may be reasonably charged. The right to obtain a copy shall not impair the liberties of other persons. Commercial secrets and intellectual property rights of third persons may bar the right to obtain a copy.

  1. Right of Rectification

According to Art. 16 GDPR, you have the right to demand the immediate rectification of incorrect personal data or the completion of the data stored.

  1. Right of Erasure

According to Art. 17 GDPR, you have the right to demand the erasure of your personal data stored as long as the processing is not essential for the assertion of the right to freedom of speech and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exertion or defense of legitimate claims.

  1. Right to Restriction of Processing

According to Art. 18 GDPR, you have the right to demand the restriction of the processing of your personal data provided that the correctness of the data is impugned by you, the processing is unlawful, you refuse the erasure of the data which we do not need any more but which you need to assert, execute or defend legal claims or provided that you have lodged an objection against the processing acc. to Art. 21 GDPR.

  1. Right to Data Portability

According to Art. 20 GDPR, you have the right to receive the personal data concerning yourself and disclosed by you in a structured, commonly used and machine-readable format or to demand the disclosure to another person responsible.

  1. Right of Withdrawal of Consent

According to Art. 7 par. 3 GDPR, you have the right to withdraw your consent at any time. As a consequence, the processing based on this consent shall not be continued.

  1. Right to Lodge a Complaint with a Supervisory Authority

According to Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority if you are of the opinion that the processing of your personal data violates applicable statutory provisions. As a rule, you may direct yourself to the supervisory authority of your habitual residence or place of employment or of our company seat.

VII. Right to Object

If your personal data is processed based on legitimate interests acc. to Art. 6 par. 1 S. 1 lit. f) GDPR and due to reasons which emerge from your specific situation or if the objection relates to direct advertising, you have the right to object to processing of your personal data acc. to Art. 21 GDPR. In case of direct advertising, you have a general right to object, which will be implemented by us without the indication of a special situation.

VIII. Security

We implement technical and organizational security measures to protect your personal data processed by us against manipulation, loss, destruction and the access by unauthorized persons. Our security measures are continuously enhanced according to technological development. Internet- based data transfers may in principle show security gaps, though we cannot guarantee absolute protection. Therefore, you are free to transfer your personal data by alternative means, e.g. telephonically or by mail. Furthermore, our employees are committed to confidentiality.

IX. Newsletter

On our website, we offer the possibility to subscribe for our newsletter. This newsletter informs you about our offers in periodic intervals. In the process of the subscription, the data from the input screen such as company name, postal code and seat of the company, a phone number, your given name and surname, a valid email address and your function in the company will be disclosed to us. After subscribing to the newsletter, you will receive a confirmation email in compliance with the double-opt-in procedure. By clicking on the embedded link, you confirm that you actually have subscribed to the newsletter and that you are the owner of the email address stated. By subscribing to our newsletter, your IP address and the date and time of the subscription will also be stored. Therewith, we ensure that your email address is not misused by third parties. In the course of subscribing, your consent to the processing will be obtained and und we will refer to this Privacy Policy. The personal data gathered through this process will be merely used for the shipping of our newsletter. It will not be disclosed to third parties. You may unsubscribe at any time. There is a corresponding link in each newsletter for the purpose of the withdrawal of consent. Furthermore, you may unsubscribe directly from the newsletter at any time by contacting the controller. Further details hereto may be gathered from the confirmation email as well as from each single newsletter.

X. Newsletter-Tracking

Newsletters of AYBEY ELEKTRONIK GmbH contain so-called web beacons. A web beacon is a single pixel transparent image embedded in such emails sent in HTML format to allow log file records or analyses. Thereby, a statistical evaluation of the success or failure of online marketing campaigns can be carried out. With the aid of the embedded web beacon AYBEY ELEKTRONIK GmbH is able to realize if and when an email was opened/read by you and which links sited in the email were accessed.

Such personal data gathered by the web beacons embedded in the newsletters will be stored and evaluated by us to optimise the shipping of the newsletters and to adjust the content of further newsletters even better to the interests of the data subject. This personal data will not be disclosed to third parties. Data subjects are entitled at any time to withdraw the declaration of consent hereof given separately by using the double-opt-in procedure. In case of a withdrawal, this personal data will be erased by the controller. AYBEY ELEKTRONIK GmbH will interpret unsubscribing from the newsletter automatically as withdrawal.

XI. Cookies

We use cookies in order to make our website user-friendly. Currently, we use persistent cookies which store the choice of language of our website’s visitors.

You may certainly use our website without cookies. Most browsers accept cookies automatically. You may prevent the filing of cookies on your terminal device by choosing the “no cookies” setting in your browser menu. Detailed information may be gathered from the instructions of your browser provider. Cookies already set on your terminal device can be deleted at any time. XII. Use of Google Tag Manager

Our Website uses Google Tag Manager, a web analysis service by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Tag Manager is a solution that enables marketers to manage site tags through interface. The Tag Manager tool itself (which implements the tags) is a domain without cookies and does not collect any personal data. The tool triggers other tags, which may collect data. Google Tag Manager does not access these data. Deactivations on Domain or Cookie-levels, will remain for all tracking tags implemented with Google Tag Manager. XIII. Links to Social Media Networks

On our website, we use links to social media networks such as Facebook, Flickr, LinkedIn and Twitter. These links are not plugins which already disclose data to the social media provider while loading the site without you being able to influence it.

The buttons used are merely links to our social media network presences. In the context of your visit to our website, user data will not be disclosed to social media networks by using these buttons.
